 Terms & Conditions Kaizen Academy

STANDARD TERMS & CONDITIONS

  1. ACCEPTANCE

1.1. Agreeing to these terms constitutes a legally binding Agreement between You and Kaizen Marketing Academy (referred to as “we”, “us” or “our”), and collectively the Parties.

1.2. You have requested access to one of Kaizen Marketing Academy’s Programs. You agree and accept that the following Terms and Conditions (Terms or T&C) form the Agreement under which we will supply the Services to you. Please read the Terms carefully. Please contact us if you have any questions.

1.3. You accept our Terms by making payment in part or full towards your Program and checking the Accept Terms and Conditions checkbox on your application form.

  1. SERVICES

2.1. We agree to perform the Services during your Program with due care and skill.

2.2. We may provide the Services to you using our employees, contractors and other providers and they are included in these Terms.

2.3. We are not responsible or liable for the marketing campaigns you develop and publish 

2.4. Our services may include face-to-face components in our Sunshine Coast location or third-party locations. It may also comprise of delivery through our Online Learning Management Systems, other online platforms and communication channels. We reserve the right that delivery mechanisms and platforms, as well as face-to-face delivery locations, may change from time to time where reasonable.

2.5. You are responsible for the organising and funding of travel or accommodation to participate in workshops and other face-to-face activities.

2.6. We reserve the right to vary these Terms, revise the content of our Programs, date of events, cancel, amend, change or reschedule part of the Program inclusions and to make other changes as reasonably required without refund ensuring 48hours notice is given.

2.7. All Program participants must adhere to our Code of Conduct at all times. This includes respectful, professional behaviour during workshops, in online groups, and across all interactions with Kaizen Marketing Academy staff and fellow members. Disrespectful, offensive, or disruptive behaviour may result in removal from the Program without refund.

  1. PAYMENT

3.1. On acceptance of these terms you are liable for 12 payments over 12 months. You may cancel with 62 days notice. You can choose from 2 payment methods:

a) Pay in full and upfront by credit or debit card or bank deposit on the date of agreeing to these Terms. If you wish to pay via direct deposit you must provide Kaizen Marketing Academy with credit card or debit card details. Your credit card or debit card will be debited in the event you do not deposit the correct payment on its scheduled date.

b) Pay in monthly instalments as outlined in the payment plan options by credit or debit card.

3.2. If you choose to pay in full upfront, the full amount will be payable on the date agreed to in your Payment form, after which your Program will commence. Note where this day falls on a weekend or public holiday, the payment may be initiated on the next business day.

3.3. If you choose to pay in instalments, your first payment will be due on your Program application date. The remaining instalments will be due each month on the same date the following months (for monthly payments) until such time that the total 12 monthly payments are paid. Where this day falls on a non-working day the payment may be initiated on the next working day. The subscription will then continue until cancelled.

3.4. The price of the Program does not include any travel or accommodation costs and additional study materials that may be required by you (such as but not limited to stationery, textbooks, electronic devices, internet connections, study aids etc.)

3.5. It is your responsibility to ensure that on each payment due date there are sufficient cleared funds in your nominated account to meet your scheduled payment. Should your credit or debit card payment decline on the agreed payment date, we reserve the right to continue attempts to process your payment. We will attempt to process the declined amount each day thereafter until successful. We reserve the right to suspend access to your Program effective immediately if you fall more than one month in arrears, in which case you may be denied access to workshops, our facilities and online communities and meet ups. Once you have cleared your arrears your Program access will be reactivated. We reserve the right to charge an administration fee of $50 for each declined payment.

3.6. Should your credit or debit card expire or be cancelled, it is your responsibility to provide Kaizen Marketing Academy with new credit card details to ensure payments continue to be successfully debited.

3.7. Once your agreed minimum Program term has ended, your Program will continue unless you advise us otherwise. We will continue to debit the amount set out in your Program Application form until such time that you advise us that you wish to cease your Membership.

3.8. We may charge interest at the rate of 12.5% per annum on any amounts unpaid 30 calendar days after the payment due date. We reserve the right to engage external debt collection services for the collection of unpaid and undisputed debt, and the right to commence legal proceedings for any outstanding amounts owed to us. You will be liable for all costs involved, including legal fees where relevant.

3.9. All amounts are in Australian dollars and include GST. We take no responsibility for exchange rate fluctuations or changes in GST rates, and reserve the right to increase the gross price should GST rates increase.

3.10. Our pricing structure, payment methods, payment processes and these Terms may be amended at any given time at our discretion. All other changes will apply from the date that the amended or new Terms are posted on our website or are provided to you, whichever is earlier.

  1. PROGRAM SPECIFIC TERMS

4.1. Participants of specific Programs can withdraw at any time by providing two (2) full calendar months notice, or 62 days notice, or payment of two (2) full calendar months fees in lieu of notice.

4.2. For all Programs, additional inclusions must be used during the Program term.

  1. TERMINATION

5.1. Any requests to terminate your Program must be sent in writing to su*****@***************om.au

5.2. Except for any situations listed in the Program Specific Terms, termination prior to the completion of your minimum term will require that you give 62 days notice.

5.3. If paying by instalments, you will be required to pay Kaizen Marketing Academy in full for two more installments.

5.4. If your Program was Paid in Full, there will be no refunds, or changes of mind.

5.5. You are liable to pay the total minimum Program fees in full regardless of the timing of the termination date, whether you have consumed any services or your perceived value of the service received. No refunds apply.

5.6. The date of termination is the date where we receive your written request to terminate your participation in the Program.

5.7. We may pause or terminate the Terms immediately and your access to your Program at our sole discretion if: a) your account is in arrears for more than one calendar month; or b) you breach any part of these Terms; or c) you breach our Code of Conduct; or d) you are involved otherwise in any illegal activities inside or outside of this Agreement.

5.8. On termination of these Terms by us you agree that any payments made are not refundable to you, and you are to pay all outstanding Program fees for the minimum Program terms for Services rendered to you up to the date of termination.

5.9. On termination of these Terms you agree to promptly return (where possible), or delete or destroy (where not possible to return), our Confidential Information and Intellectual Property, and/or documents containing or relating to our Confidential Information and Intellectual Property.

5.10. The accrued rights, obligations and remedies of the Parties are not affected by the termination of these Terms.

5.11. On termination of your Program, we will remove your access to all of our Services, including online communities and face-to-face workshop and event access and we will not be liable for any claims related to the removal of your access.

6. MARKETING RESPONSIBILITY

6.1. You acknowledge and agree that Kaizen Marketing Academy is not responsible or liable for any marketing materials, strategies, campaigns, or content that you or your business create, publish, or implement as a result of participating in our Programs. Any marketing executed in your brand’s name is your sole responsibility, including ensuring it complies with applicable advertising laws, brand guidelines, and industry regulations.
